User terms of service

Through its website and mobile app (jointly, the "Delasto Platform"), DELASTO provides search and last-minute booking services ("Services") for holiday homes, hotels, and accommodation properties ("Properties"), offering its users an overview of Properties immediately available throughout Italy and putting them in contact with the owners ("Property Providers") of those Properties.

Registration and booking on the Delasto Platform are free of charge for the user.

Access to and use of the Delasto Platform are offered to the user subject to acceptance, without modification, of all the terms and conditions set out below (jointly, the "Terms").

The Terms constitute a legally binding agreement between the user and DELASTO governing the user's right to use the Delasto Platform and the published offers. If the user does not accept these Terms, or even only one of the provisions contained in the Terms, the user may not use our Services or access the Delasto Platform.

By accessing and using our Services and the Delasto Platform, the user confirms that they have read, understood, and accepted these Terms, including the Privacy Policy and the Cookie Policy.

DELASTO reserves the right to modify these Terms and the Privacy Policies at any time and at its sole discretion. Such updates may be necessary due to the introduction of new regulations, legislative changes, or technological developments affecting the provision of our Services or the use of our Platform. Any modification made will aim to ensure compliance with applicable laws and to maintain high security standards in the use of the features offered. We recommend consulting the available Terms and Privacy Policies regularly, so as to remain constantly informed of any change that may affect your rights or the ways in which the offered Services may be used.

Platform use conditions

Use of the Platform is granted on the condition that the user accepts the following.

Access to and use of the Services and the Delasto Platform must take place exclusively in compliance with applicable laws and only for lawful and personal purposes, excluding any commercial purpose. In order to use the Delasto Platform and the Services, the user must be at least 18 years old; this is to guarantee the safety and protection of minors.

The following are expressly prohibited:

use of the Services or the Delasto Platform for any improper or unlawful purpose, or to publish, share, or transmit any material that: (i) is unlawful, harmful, defamatory, offensive, or obscene; (ii) violates confidentiality, privacy, or the rights of any third party, including copyright, trademark, or any other intellectual property right; (iii) is published, shared, or transmitted for the purpose of advertising or promoting oneself or third parties;

copying, distributing, making public, selling, renting, lending, or otherwise using our Services or the Delasto Platform, or attempting to violate or circumvent the security measures in place to limit the user's access to or use of our Services or our platform;

using or interfering with our Services or the Delasto Platform in a way that may damage, disable, overload, impair, or compromise our systems or our security or interfere with other users, or introducing or transmitting through our Services or the Delasto Platform any disruptive or harmful code, virus, worm, Trojan, or spam;

removing, modifying, or replacing any authorship notices, registered trademarks, trade names, logos, or other designations of origin present on our Services or our platform. These identifying elements are an integral part of our Services and of the Delasto Platform and attest to their legitimate ownership and origin. Furthermore, it is not permitted to present, pass off, or attempt to pass off our Services or our platform as products belonging to parties other than DELASTO;

using unauthorized automated software, a software agent, bot, spider, or other software or application that enables scanning, copying, indexing, sorting, or exploiting, or more generally damaging, the Services or the Delasto Platform or the data contained therein.

The user is required to keep their password and access credentials for the Delasto Platform with the utmost care, taking all measures necessary to ensure confidentiality and security in order to prevent unauthorized access to their account and, consequently, to the Services and the Delasto Platform. If the user learns, or even only suspects, that the security of their access credentials may have been compromised, the user is invited to notify this immediately by email to assistenza@delasto.com. This is to allow the adoption of measures aimed at protecting the account and the security of the platform.

While using the Services and DELASTO Platforms, the user is required to maintain diligent conduct and comply with applicable laws. Any improper, fraudulent, or unlawful use may result in immediate suspension or termination of access to the services, in addition to compensation for any damages suffered by DELASTO. In accordance with these Terms, the user will be held responsible for any legal action, claim, proceeding, cost, damage, loss, or expense (including legal fees) incurred by DELASTO and arising from the use of the Services or our platform, or from a violation of these Terms.

If part of our Services or our Platforms is hosted on third-party websites, such as Facebook or other social media platforms, then in addition to the obligations arising from the use of the Services and the Delasto Platform, the user must also comply with the rules established by those third parties, where applicable, in order to ensure compliant and responsible use of those platforms.

DELASTO, at its sole discretion, may immediately terminate any agreement with the user, at any time and upon notice to the user and/or, if the user has an access account, by canceling access to that account and removing any user content uploaded to the Delasto Platform.

Bookings and content

The booking made by the user takes place directly with the selected Property Provider. DELASTO merely makes available a platform that allows the display of offers and communication between the parties, without participating in the contractual agreement established between the user and the Property Provider. The Property Provider is solely responsible for the availability of the property, the accuracy of the information provided, and the management of the services offered to guests. Every interaction with Property Providers through the Delasto Platform takes place under the user's full responsibility.

In the event of booking cancellation or no-show, any refund will depend on the relevant Property Provider's conditions, as will every other aspect related to booking confirmation, compliance with conditions, accuracy of details, quality of services, or anything else governed exclusively by the direct relationship between the user and the Property Provider; any issues relating to these aspects must be addressed directly with the Property Provider. In the event of any issues relating to bookings, DELASTO disclaims all liability, as it is not involved in the direct management of the Properties or in the contractual relationships between the user and the Provider.

The user is required to read, understand, and fully accept all conditions, cancellation policies, accommodation specifications, payment methods, and general rules provided by the selected Property Provider before proceeding with the booking, since they govern the rights and obligations arising from the relationship established directly with the Property Provider. In case of doubts or the need for clarification, the user must contact the Property Provider directly to receive support and additional information.

When the User books a property, that same user accepts and undertakes to pay all charges for the booking, including the price indicated in the listing and applicable costs.

By using the Platform, the user confirms that they have understood that the presence on the Delasto Platform of a property or of certain Property Providers in no way implies, suggests, or constitutes a recommendation, nor does it represent any promotion by DELASTO of that specific accommodation or of that Property Provider.

The Delasto Platform hosts content provided directly by Property Providers such as prices, images, and other information, as well as content provided by users and/or other sources such as comments, ratings, and other information (jointly, the "Content"). DELASTO is in no way responsible for the accuracy, quality, completeness, reliability, or trustworthiness of the Content. Although DELASTO regularly updates information relating to available offers, it cannot ensure that every detail is always updated in real time and does not guarantee that the Property Provider's Content, in particular the prices shown there, is always updated in real time or that a given property is available.

Privacy

The user acknowledges that the personal data submitted by the user to the Delasto Platform is used by DELASTO in compliance with and in accordance with data protection laws.

The user is obliged to provide accurate and up-to-date personal data so that we may use such information in accordance with these Terms and our Privacy Policy.

Intellectual property of the Services and the Platform

All intellectual property rights relating to the Services and the Delasto Platform remain the exclusive property of DELASTO, or are held by DELASTO under valid licenses. These rights include, by way of example and not limitation: copyright including rights relating to computer software, patents, registered trademarks, trade names, design rights, database rights, know-how, trade secrets, and any other right relating to the confidentiality of information.

Use of the Services and the Delasto Platform does not imply the acquisition by the user of any right, title, or interest in such intellectual property rights. If the user copies or uses any part of the Platform in violation of these Terms, DELASTO will immediately block the user's access to the Delasto Platform and the Services offered.

If the user provides us with suggestions, comments, improvements, ideas, or other comments ("Feedback"), the user undertakes to irrevocably transfer the intellectual property of such feedback and consents to its use and sharing for any purpose we deem appropriate, at our discretion.

Limitations and exclusions of liability

These Terms define all DELASTO obligations and liabilities in relation to its Services and the Delasto Platform.

DELASTO has no liability for any agreements entered into with third parties following the use of the Services or the Delasto Platform. In order to ensure maximum transparency and security, the user is invited to consult on the individual Property Provider's website the specific conditions applied before proceeding with the booking. In case of problems with a booking already made, the user must contact the Property Provider directly. Any refunds or solutions are the sole responsibility of the Provider itself, and not of DELASTO.

Where our Services or our Platforms refer to other sites and information provided by third parties, such links are provided for informational purposes only. DELASTO has no control over the content of such sites and assumes no responsibility for them or for any loss or damage that may arise from their use. Third-party advertising material may also appear on the Delasto Platform. Advertisers are solely responsible for their content and DELASTO assumes no responsibility for any errors, omissions, or inaccuracies.

To the extent permitted by law, DELASTO is not responsible for (i) inaccuracies or omissions in content shown or found through its Services or the Delasto Platform, nor (ii) for losses, damages, accidents, or delays of any kind resulting from the use or inability to use its Services or the Delasto Platform.

We do not guarantee that our Platform will always be available, uninterrupted, secure, or free from bugs or viruses, nor that the Platform will be free from errors or omissions.

We will not be liable for any delay or failure resulting from causes beyond our reasonable control, including any non-performance due to unforeseen circumstances or beyond our control, such as by way of example: force majeure, war, terrorism, unrest, acts of civil or military authorities, fires, floods, accidents, strikes, epidemics, other natural disasters, shortage of transport, fuel, energy, labor, or materials, or lack of public or private telecommunications networks. In such cases DELASTO cannot be held liable for any service interruptions or loss of data.

These limitations apply regardless of the nature of the damage, whether direct, indirect, consequential, incidental, or special.

Final provisions

These Terms represent the entire current agreement between DELASTO and the user and replace all previous terms, conditions, and agreements relating to the use of our Services or the Delasto Platform.

The invalidity or unenforceability of any provision (in whole or in part) of these Terms does not affect the validity or enforceability of the remaining provisions (in whole or in part). Furthermore, our failure to enforce any of these Terms cannot be interpreted as a waiver, nor as a limitation on the right to enforce compliance with them in the future.

Unauthorized use of the Services or the Delasto Platform may cause irreparable damage to DELASTO and/or its affiliates, not compensable in money. In such cases, we reserve the right to immediately seek injunctive relief and other remedies provided by law.

These Terms are governed by Italian law. Any dispute relating to them is subject to the exclusive jurisdiction of the Court of Rome.
